Care Jar Pty Ltd provides high-quality disability support, mentoring, and domestic support services to NDIS participants and private clients within South Australia. We are deeply committed to protecting the privacy, confidentiality, and dignity of our clients, staff, and stakeholders.

This Privacy Policy outlines how we collect, use, disclose, store, and manage personal and sensitive information in compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the NDIS Quality and Safeguards Commission requirements, and relevant South Australian legislation.

To deliver safe, effective, and compliant care, we must collect information that falls under two primary categories:

  • Personal Information: Includes names, contact details (phone, email, address), dates of birth, emergency contact details, billing information, and NDIS participant identification numbers.

  • Sensitive & Health Information: Includes medical diagnoses, behavioural plans, physical or mental health statuses, medication logs, daily support/shift notes, goal tracking data, NDIS plans, and specific care preferences.

 

3. Methods of Data Collection

We collect information through transparent, lawful means, directly from the participant or their authorised representatives:

  • Service agreements, intake packs, and client onboarding forms.

  • Daily shift reports, progress notes, and communication logs completed by our mentors and support workers.

  • Formal correspondence with clients, families, nominees, or legal guardians.

  • Referrals and official documentation shared by NDIS Plan Managers or Support Coordinators with explicit consent.

4. Use of Personal and Sensitive Information

Your information is utilised strictly to facilitate personalised support services, ensuring administrative accuracy and clinical safety:

  • Tailoring and delivering specialised support, mentoring, and domestic assistance.

  • Ensuring service safety, emergency crisis management, and fulfilling our duty of care.

  • Managing billing, processing NDIS claims, and administrative record-keeping.

  • Meeting strict regulatory reporting obligations enforced by the NDIS Quality and Safeguards Commission.

 

5. Disclosure of Information & Mandatory Reporting

We do not sell, rent, or lease your personal data. Your information is only disclosed to third parties under explicit consent or strict legal obligations:

  • NDIS Framework: Sharing progress logs or invoicing requirements with the National Disability Insurance Agency (NDIA), NDIS Plan Managers, or Support Coordinators to manage funding.

  • Auditing & Compliance: Authorised third-party auditors reviewing operational safety under NDIS Commission mandates.

  • Emergency Services: Medical practitioners, police, or paramedics if there is an immediate threat to life, health, or safety.

 

MANDATORY REPORTING OBLIGATION (South Australia)
Under the South Australian Children and Young People (Safety) Act 2017, Care Jar Pty Ltd personnel are Mandated Reporters. If any support worker, mentor, or manager suspects on reasonable grounds that a child or young person (under the age of 18) is at risk of harm, abuse, or neglect, we are legally required to report these concerns to the Child Abuse Report Line (CARL). This statutory obligation explicitly overrides standard client confidentiality and privacy provisions.

6. Data Security, Storage, and Retention

Care Jar Pty Ltd implements rigid technical, administrative, and physical safeguards to defend your data against loss, unauthorised access, or misuse:

  • Digital records are retained in encrypted, password-protected, role-restricted cloud systems.

  • Physical files are held in secure, locked premises accessible only to cleared personnel.

  • Records are safely retained for a minimum of 7 years following service termination, or 7 years after an underage participant reaches 18 years of age, matching NDIS requirements.

Clients have a right to access the personal information Care Jar Pty Ltd holds about them. You can request updates, corrections, or digital copies of your profile by emailing our Privacy Officer. We process valid amendments promptly, ensuring files remain accurate, objective, and up-to-date.
